Tinubu FOIA case enters another crucial stage as the FBI seeks to keep some records confidential, while a US court weighs disclosure of files linked to a 1990s investigation and $460,000 forfeiture.

The Tinubu FOIA case has entered another important stage in Washington, with the FBI asking a US court for permission to privately explain why some records linked to President Bola Ahmed Tinubu should remain withheld. The development has renewed questions in Nigeria over transparency, accountability and the handling of allegations dating back more than three decades.

The records are connected to a US investigation into a Chicago-based heroin trafficking and money-laundering operation in the early 1990s and a 1993 civil forfeiture involving $460,000 that Tinubu surrendered to US authorities.

US District Judge Beryl Howell has been overseeing the long-running Freedom of Information Act (FOIA) dispute brought by American transparency advocate Aaron Greenspan. The Justice Department recently asked for an additional 10 days to respond to the court’s disclosure order.

Tinubu’s legal team joined the request, but Judge Howell granted only four extra days and set August 21, 2026, as the deadline.

The August 21 deadline did not mean the records would automatically become public. Instead, it required the government and Tinubu to respond to the court over the disclosure dispute.

The latest development came on August 20, when the FBI asked Judge Howell for permission to submit a confidential declaration explaining why it withheld certain information. The bureau said it wanted to make the explanation ex parte and under seal, meaning the material would be reviewed privately by the court.

If approved, the FBI said it intends to submit the confidential explanation by August 28.

What The Tinubu FOIA Case Is About

Greenspan filed the lawsuit after submitting multiple FOIA requests to US federal agencies seeking records connected to past investigations involving Tinubu and other individuals.

Court records show that Greenspan submitted 12 requests to six agencies between 2022 and 2023. The requests sought records from agencies including the FBI, Drug Enforcement Administration (DEA), Department of Justice and other federal bodies. The case focuses on records associated with an early 1990s investigation into drug trafficking and money laundering in Illinois.

Judge Howell ruled in April 2025 that the FBI and DEA could no longer rely on so-called “Glomar” responses in relation to certain records involving Tinubu. A Glomar response allows an agency to refuse to confirm or deny whether responsive records exist.

The judge found that the agencies had not provided a sufficient legal basis for continuing to keep the existence of certain records secret.

The 1990s Investigation And $460,000 Forfeiture

The records being sought are tied to a 1993 civil forfeiture case in the United States involving bank accounts associated with Tinubu.

According to US court documents, Tinubu surrendered $460,000 to the US government as part of the forfeiture proceedings. The case was connected to an investigation into a Chicago heroin trafficking operation.

However, the forfeiture was a civil proceeding, not a criminal conviction. Tinubu has consistently denied wrongdoing and was never criminally charged with drug trafficking in the United States.

That distinction remains important because the existence of an investigation, civil forfeiture or government records does not by itself establish that a person committed a criminal offence.

A 2003 letter from the US Consulate in Lagos to then Inspector-General of Police Tafa Balogun also stated that FBI records showed there were no criminal arrest records, wants or warrants for Tinubu.

Why The FBI Wants Some Records Kept Private

The FBI has cited several FOIA exemptions in defending its decision to withhold portions of the records. Among them are exemptions covering personal privacy, confidential information, law-enforcement procedures and information that could potentially endanger an individual’s life or physical safety.

The bureau says some of its reasons cannot be fully explained in a public filing. It therefore wants to give Judge Howell a confidential explanation so the court can examine the disputed material and the basis for the exemptions privately.

That request does not mean the court has agreed that the records should remain secret. The judge will have to consider whether the FBI has met the legal requirements for withholding the information.

Political Questions In Nigeria

The case has attracted renewed attention in Nigeria, particularly as President Tinubu prepares for the 2027 presidential election.

Critics have questioned why records connected to an investigation from the 1990s are still being contested in court more than 30 years later. Supporters of disclosure say Nigerians deserve clarity about the background of anyone holding the country’s highest political office.

At the same time, the legal dispute has produced competing interpretations of what the latest filings mean.

Tinubu joining the government’s request for more time does not, on its own, prove that he is trying to permanently prevent the release of the records. The request was made within an ongoing court process over how and when the agencies should respond to the disclosure demands.

The issue previously featured prominently during Nigeria’s 2023 presidential election litigation. Opposition candidates Atiku Abubakar and Peter Obi raised the 1993 forfeiture as part of their arguments against Tinubu’s eligibility. The Presidential Election Petition Court ultimately dismissed the petitions and upheld Tinubu’s election.

The immediate issue is now the FBI’s request to submit its confidential explanation by August 28. The court will determine whether the bureau has provided enough legal justification for keeping the disputed material from public release.

Depending on that decision, some records could remain withheld, while others may have to be released or processed further.

The earlier court ruling against the FBI and DEA’s Glomar responses was significant because it required the agencies to address the existence of certain records rather than simply refusing to confirm whether they had them.

Greenspan’s broader effort, however, is not simply about proving or disproving allegations against Tinubu. His lawsuit concerns whether US government agencies have properly handled his FOIA requests and whether records that are not legally exempt should be disclosed.

The dispute has raised a familiar question about the balance between public access to government records and the protection of sensitive information. Those seeking disclosure argue that public officials should face greater scrutiny, particularly when historical allegations remain politically relevant.

On the other side, US agencies have argued that investigative files can contain private information, confidential sources and details about law-enforcement methods that may be protected under FOIA.

Judge Howell’s previous decisions have already pushed the agencies to provide stronger legal reasons for withholding certain information. The latest FBI filing shows that the disagreement over what should be released is still unresolved.

Why The Case Matters

For Nigerians, the Tinubu FOIA case has become part of a much wider conversation about political accountability and how allegations from a leader’s past should be addressed. For the US court, however, the immediate question is narrower: whether federal agencies have complied with FOIA and whether the exemptions they are relying on legally justify withholding the disputed records.

The next major date is August 28, when the FBI says it intends to provide its confidential explanation if the court grants permission.

Whatever follows, the case is unlikely to disappear from Nigeria’s political conversation soon. Tinubu continues to deny involvement in the narcotics trade, while the US litigation over the records moves into another stage.

For those demanding disclosure, the focus now is on what the court decides should remain private and what, if anything, must finally be made public.
